GOODS RETURN POLICY 
 

Any Firebox product that is purchased will be covered by our 12-month goods replacement warranty.  The goods are to be returned to Firebox for inspection and then a credit will be processed, or goods replaced.  Our elumen emergency lights carry a 3 or 5yr limited warranty.


Firebox does not credit aged/dead stock as we work with our customers to ensure the right amounts of product are being ordered, therefore we, nor our client has a problem with stocking the right amounts.


Restocking Fee: If Firebox supply or manufacture a product on behalf of a customer and returned which is not in resalable condition (the product must be in the original carton/package with no markings or damage) no refund will be offered or if we purchase on instructions by client unless Firebox is not charged a restocking fee, this restocking fee which is generally 20% will be passed to the customer. Firebox will accept returns up to 30 days from purchase otherwise a 20% restocking fee will occur. Firebox will not cover the costs associated with returning the product or goods.

 
FIREBOX PRODUCT WARRANTY TERMS & CONDITIONS
 
Our products are guaranteed against defects for a statutory period of 12 months from date of purchase. This warranty is provided by Firebox Australia Pty Ltd ABN 75 116 370 793 of 16 Craftsman Cl, Beresfield NSW 2322 Ph 1300 123 678

Firebox Australia Pty Ltd will offer a repair, replacement product or credit if the product is assessed as being defective during the warranty period. In order to claim under the warranty you must follow the procedure set out in these conditions:
Claims and Exclusions
a. The Supplier shall not be liable for any loss or damage whatsoever and howsoever arising, whether direct, indirect or consequential or in respect of any claim whenever and however made for any loss or damage, deterioration, deficiency or other fault or harm in relation to the Goods whether occasioned to the Customer or any third or other party, except to the extent caused by the Suppliers negligence.
b. The Supplier shall not bear any liability where the Customer:
i. Fails to property maintain the Goods;
ii. Fails to properly store the Goods;
iii. Uses the Goods in a way that is different to their intended use and purpose;
iv. Continues to use the Goods after a defect becomes apparent, or would have become apparent to a reasonably prudent operator or user;
v. Interferes with, alters, changes or does something to the Goods to change the way they operate, without the written consent of the Supplier;
c. As soon as any of the facts or matters which form any part of any claim or complaint whatsoever become known to the Customer, the Customer shall, within twenty-one (21) days, notify the Supplier in writing of the same.
d. Within twenty-one (21) days of receiving the Goods, the Customer must notify the Supplier of any non-compliance with specifications of the Goods or any damage or defects in the Goods. Failing such notification, the Customer is deemed to have accepted the Goods in their present state and condition.
e. If, after twenty-one (21) days of receiving the Goods, the Customer notifies the Supplier of any non-compliance with specifications of the Goods or any damage or defects in the Goods, then the Customer must pay the Supplier 20% of their Purchase Price of the Goods to cover the Suppliers costs of taking action in accordance with the Customers notification.

Firebox may require further information from you. We may also need you to send the defective product back to us (if suitable for sending by post) so that we can properly investigate the defect.

Faults or defects caused by product modification, misuse and abuse, normal wear and tear or failure to follow user instructions are not covered under this warranty.
Firebox must be given a reasonable opportunity to investigate and rectify the defect. If it is necessary for us to visit your site to do so, you must give us prompt and proper access. Firebox reserves the right to use its own contractors for investigation and rectification.

Firebox will use best endeavours to rectify any genuine defect within 1 calendar month of being notified in writing, but this period may be extended by factors beyond our control, such as the need to source components from overseas.
If in an emergency situation it is necessary for you to take immediate rectification steps, you must use best endeavours to consult with Firebox before doing so, and must in any event notify us immediately.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Any expenses incurred relating to the return of this product to Firebox will normally have to be paid by you.

Where reimbursement applies, Firebox will reimburse only the actual cost of the product, without mark-up. Firebox will pay that reimbursement, and applicable compensation (if any) only where the procedures set out in the terms and conditions have been fully complied with.

The benefits to the consumer given by this warranty are in addition to other rights and remedies of the Australian Consumer Law in relation to the goods and services to which this warranty relates.
